They try to and some do reappear. It all depends on the rights holder.

In this case, the licensing rights are changing hands to another publisher and there's no confirmation that publisher has an intent to keep selling here.

Yes, (most) digital stores sell with direct contact with the publishers/devs. They decide whether they sell to this store or not. So if the publisher changes, the new publisher will have to make an agreement with GOG to sell here. I'm guessing Bethesda hasn't gotten back to them on it or came back with a negative. They probably only care about working on the new Fallout with the license and they're not particularly pro-Drm free I think.

I imagine in some cases they're trying up until the last minute to keep games in their catalog, or at least to keep the door open if the rights-holders change their minds. Announcing a removal too early works against that. However, it would be very nice to have last chance alerts posted in a permanent easy-to-check location.
Yeah i wish we had a day or 2 time to buy the game in case it would get removed.
Looks like the Fallout games have already been pulled from sale from Desura, the publisher has changed from Interplay to Bethesda Softworks.

According to http://www.gog.com/forum/fallout_series/december_30th_last_day_of_interplays_license_to_sell_the_old_fallout_games Interplay doesn't lose them until the 30th.
