There are some companies that are hit and miss. For example, Ubisoft's Prince of Persia was released with no DRM. Stardock's an odd case.
All their retail games are (and will be) released with no DRM, but you'll need Impulse to get patches.
The Witcher had the DRM patched out. So did NWN2. So have other games.
I believe Paradox releases their games with no DRM, but I could be mistaken.
Some games from D2D are DRM free.
It's really something you have to do some research on. Seems funny, but if you want to get DRM-free games, you have to put in more time researching the DRM schemes used (if any) than you spend finding out about the game itself.

True, I wanted to purchase Scrabble Blast for someone and I wrote Microsoft asking about any DRM in the game, they did not answer but pointed me back to the game info page for the game system specs. *sigh Of course I never bought it.
some companies are not forthcoming and I think not honest with their customers when they ask honest questions about what is going to be installed on their computers.
DRM policy varies with publisher and games.
THQ published Stalker:Shadow of Chernobyl DRM free. The second, Stalker: Clear Sky had severe DRM restriction.
A number of Aspyer published games has no DRM. Dark sector, Men of War, Death Track: Resurrection, Cryostasis, Necrovision, and 4X4 Hummer all have no DRM.
A number of wargames publisher are DRM free. For example, Matrix games published DRM free wargames.
If you count indie games then a ton of those are DRM free. World of Goo by 2D Boy is one example.
We should create a list of all known Companies and Games that are Truly DRM Free.

What about updating your opening post with titles and developers/publishers as people post suggestions?

Good Idea, I will.
I confirm for paradox games and only the game they produce themselves are DRM free so far.
Patched versions of the Unreal & Unreal Tournament series only require serial keys for installation.
Pathologic doesn't require the disc or a serial.
Dawn of War and its expansions have been patched to remove disc check.
Civ 4 beyond the sword : DVD edition has removed the CD-Check DRM with the latest patch tough Securom may remained installed on the PC but I risk to say that you can uninstall it without issues if you know how to do it.
The Witcher : Tagès removed with the latest patch, tough this may cause dysfunction with other games that uses Tagès.
X3. Reunion : Starforce removed with the latest patch.
X3 Terran Conflict : DRM supposed to be removed someday at least it's what they say on their forum.
Armageddon Empires : http://www.crypticcomet.com/games/AE/armageddon_empires.html
Indie DRM-free game.
AGEOD games : http://www.ageod.com/en/ Indie-niche wargames. Their production can be considered DRM-free so far as they only need a valid key to be launched. Other games on their sites have DRMs.
Osmos (if bought on the developer's site) is DRM free, the download link on the other hand, is only availible 5 times, although you could probably get another if you mailed them.

The patch only removes the protection from the game. The stupid drivers still remain installed. They caused me quite a few problems with 7 x64. They surely did add several more seconds for me to wait, for Windows to boot. And after every boot, a driver compatibility issue message was coming up.
But I fixed it easily, by deleting the files manually (the official removal tool doesn't work in 7 x64).

...i think, in essence, all 'old' games are the safe ones when it comes to DRM-free. You just cannot be sure on any other, and as said, we know have the silly situation where we spend more time researching for a game DRM-infected or not. That said distribution might have something to do with it as well. For example, i have Warlords Battlecry III and that's the actual retail game in a DVD box (bought way before GOG.com). And that game DOES have a check wich IIRC is starforce or whatever (its installed on older PC and i'm away, and can't properly remember, but its that grey symbol that reminds me of star trek :B ).
Now, that game is also at GOG and believing the site's guide lines, it should be free of such thing. (anyone that got that game at GOG please verify this for me? thkx :] )
Also, Unreal and UT (thats the original game), do not require anything really other than install (again, these are the actual CD retail versions). I suppose that UT2004 at GOG requires only a CD-key?...

ALL games on GOG are fully DRM free, no exceptions. Some games have a CD key (UT, for example), but that is already set up at install time, if you want a new key to play online (in case the server you're connecting to detects a duplicate key or something) just send a mail to the support team and you'll get a new one.
