Class action suits are basically about punishing companies, not about providing any kind of meaningful restitution to the class involved. Trying to get things righted after the fact pretty much always fails in these kinds of situations- rather, assume from the beginning that you're going to get screwed at some point, then take whatever measures are necessary beforehand to ensure that whatever gets pulled has a minimal impact on you.
I have found in my life that the important thing in life is to ensure that justice is served, even if it's not served well. In an ideal world for example, you would be guarenteed your D2D purchases, or someone that struck an unmarked pothole would have their wheel replaced.
If in the real world, you have to settle for the company selling the games to have to pay out much more to the lawyers in the class action suit than they could have spent fixing the problem, or you take the city to small claims court just to force them to incur costs, than so be it. Eye for an eye.
