I wouldn't worry. Zenimax is very business minded, and if they see GOG as an additional source of cash flow, why not?
This is unlike the case of TOCA 3, where licensing issues were involved, and the persecuting side wasn't Codemaster, but the car companies I think. I'm not entirely sure what went on in that case, but I think this was roughly what happened.

I can tell you this much, but I cannot quote my source (though I have one), that the ONLY games that existing users can lose the right to download after their removal from the catalogue are those with licenses WITHIN them. So for example, if a soccer game had the license of the FIFA lets say for 10 years with Electronic arts, and GOG offered let's say FIFA 2000 on here. If the FIFA got wind of the game being offered for sale in 2010, they might ask GOG to remove it. In that case, existing users would lose the rights to download the title, due to the licenses WITHIN the game betweena third party and the publisher. Another example would be a Skateboarding game with Vans sneakers as in-game items.

Well luckily I got all three fallout games available here purchased and archived. I download and archive locally to my personal file server everything I buy here just in case. But it sucks for other people if gog has to stop selling them. :(

My copy of the Trilogy says "3 Action packed Fallout games in 1 collection. The games are about as clearly labelled on the front and back as the terrible Photoshopping will allow though.

Hate to side with the larger company with the lesser catalogue, but Bethesda/Zenimax is in the right here, and it looks like Interplay will fall for good now. That also means Bethesda gets the rest of their IP in a settlement, I bet.
With the MMO, dates were established to meet certain conditions and milestones, and we have known for a while they did not meet those things. With the collection, if the contract said Zenimaz apporves all rereleases, and Interplay did not go through them with the collection, I would say they violated that as well.
Who knows why Interplay acted so foolishly, but the we could say those same words 100 times over the last 10 years.
In any case, I look forward to reading the results of this, and maybe seeing what Zenimax does with all that Interplay IP.

Agreed. I don't know about Interplay turning over their other IP to Bethesda, but they're likely to arbitrarily sell it off all the same. I just hope it's kept away from EA.

SOunds like Interplay are making stupid deals. They should of allowed Beth to make Fallout 3 but kep 1,2 and tactics to them selfs. Made a mint off of the FO3 release and retired happy.

Zenimax would get it if the court rules for a monetary settlement that Interplay cannot pay, probably. They would turn over their assets to Zenimax instead of payment, and their IP are assets.
That said, it might never get that far.

Zenimax wouldn't automatically get any of Interplay's non-monetary assets if a court awards a monetary judgment that Interplay can't pay. Rather, Interplay would be forced into bankruptcy (most likely Chapter 7), and the court-appointed trustee would then sell off all of Interplay's assets to the highest bidders. Zenimax would then have to get in line with any other creditors Interplay owed money to to try to get a cut of whatever money was raised by the sale of Interplay's assets.

What DarrkPhoenix wrote. If they are made bankrupt then Interplay's IP will effectively be scattered to the four winds. Bethesda will simply see the money from that.

Let's not jump to conclusions here. We don't know how it will pay out, and I'm pretty sure the worst case scenario would be Interplays loss of the rights to the original Fallout games. Bethesda has a case, but a) they'll probably settle out of court and b) it wouldn't be so large as to bankrupt Interplay, because neither Bethesda nor Interplay want that.
