The other games have been re-released at the same time, yes. But Planescape was one that Atari never has sold. They never bought the rights to it from Interplay and there's some speculation as to whether or not that's because Hasbro don't want games sold with such an old rule set.
So, effectively neither publisher has the right to sell the game. Interplay don't have the D&D license. Atari don't have the copyright to Torment.
But it's Interplay's logo on the box. The fact that it was re-released the same time as the ones Atari does now own would suggest some kind of a deal going on. But with Interplay denying all knowledge and their logo and copyright info on the box it's hard to say exactly what is going on. I doubt that Hasbro would approve. Which could be a part of the reason Atari is on the receiving end of a lawsuit.
