Hate speech is always forbidden, for good reason, it is ONLY, if the company behind does not react. Which funny enough, by normal criminal law in most states you would go behind jail, for knowing about something like this. SO companies are getting of light, despite what a lot of people are claiming.

At least that's my interpretation of the article.
There's a big difference between the occasional sexist joke and hate speech.
So I think people are over-exaggerating the consequences of this ruling.

Yah, no one has anything to worry about. Those are concrete terms with clear definitions which AREN'T normally twisted around to label entire groups of people.

This is the reality in Germany since forever and has nothing to do with grinding down your rights of free speech. "You fucking idiot! I'm gonna beat you up and pay twenty HIV positive junkies to butt-rape you!" is NOT free speech. Posting nudies of your ex is NOT free speech. Offering weapons and drugs is NOT free speech. These things are crimes in the real world, so they're crimes online too. If you, as a website owner, don't give a fuck about this, you're offering criminals a place where they're welcome to commit crimes. This does NOT mean that the people who commited the crimes are not responsible for them. It only means that you are seen as a person who supports them. It's your house, so keep it clean.

There is a separate court, which defends freedom of speech and e-commerce and has previously ruled that a site CANNOT be held accountable, nor forced to monitor its users comments.

No they're not, because the problem here is the varying measures and approaches people and organizations take as to what constitutes hate speech. Those are not specified and they are prone to abuse.

A recent case, someone made a black humour joke about the holocaust. Even if the poster meant it as an example of crass and cruel humour with no further intentions, there's a 100% chance that somebody, somewhere will cry outrage and become offended and demand it be taken down and measures taken against both the poster and the site.

And that's what they're afraid of, how do you tell when someone is being truly virulent and hateful as opposed to being simply crass and tasteless? Depending on the lawyer, the difference is the amount of the settlement.
