That's... that's not what he said. He said that (in some US state, I guess) online gambling is a criminal offense on par with storing cp. And apparently, that's true. Holy prohibitionism Batman.

And that's one of the most liberal jurisdictions in the United States. (King County, Washington) Luckily, as of that writing years ago, "No cases have been prosecuted." And apparently, that's true. Holy prohibitionism Batman.
We still criminalize a lot of consensual crimes up here, but at least we don't bust pot smokers anymore. :)

Part of the problem here is that Daedalic blows chunks.
They're a truly awful developer. Recycled art styles, recycled puzzles, annoying pixel hunts, fake difficulty trial-and-error frustration, lame sense of humor and poor story writing.
And they're considered "indies", which means that there's a chance that one of the stinking turds they mislabel as a game will end up as your "prize".

He skewed the facts to support his argument. Heavily. Do you think any state would prosecute someone for buying a random game? If any US state punishes buying a random game the same way it punishes possession of child pornography then that sate needs to be kicked out the Union.

Tried it once, got "Gods will be watching - Special Edition".
The result could have been worse, but I'm not tempted to try it a second time, especcially since I could also get keys for games that I already own.

I wouldn't spend three dollars for a mystery indie game myself. For one thing, I already have the indie games I want pretty much. Even if I didn't though, I'd rather know what I am buying personally.
This is really easy though. If you feel like I do just don't buy one. If you do take a chance and it doesn't work out well that was your roll of the dice you made and paid for. I don't know why anyone would complain after the fact when they knew exactly what they were doing, at least I hope they did.

Yeah, aha, no. Just no. Go digging in my shit for corn. They are, in fact, probably my favourite developer. Great games, beautiful too look at, great stories, fun characters, good music, and puzzles that almost never leave you randomly guessing, or with any sort of trial-and-error. I have made it through Deponia 2, A New Beginning, Chains of Satinav and Memoria never using any hints or walkthrough, and only used it once in Deponia 3 and once or twice in , Edna & Harvey: Harvey's New Eyes and Night of the Rabbit (Deponia 1 was their first game I played, and part of my come back to adventure games, I was rusty, so I had more problems with some puzzles, so I'm not counting that one). And even then I had to admit I should have thought of the solution myself. And how in the hell can you have pixel hunting, when in every one of their games you can highlight every interactive thing on the screen by pressing space? They're a truly awful developer. Oh, and Blackguards was a really good RPG. The combat was a little to dependant on luck, but that's what you get for sticking to tabletop roots.
I'm not going to buy any pinatas, but if any of Daedalic's games I'm still missing show up on sale I'll be sure to grab them.

Look, I'm not a lawyer nor I am american. *IF* this pinata stunt can be considered online gambling in the US, then yes, it should fall under class C felony. End of the story. That doesn't mean he personally thinks it is as bad as CP or animal torture. That's your interpretation. As far as I'm concerned he just meant that this is a pretty bad practice for a business, and added the comparison for extra effect.
But this is something he will clarify himself, I have no interest arguing over a perceived sense of morality.
