You know, it occurs to me, that the easiest way to get these two games made available and somewhat patched, would be for the holder of the source code to share it with someone .... perhaps even close at home.
Night Dive for instance were such an entity, and they seemed to have put a fair amount of effort into trying to obtain the games to re-release them. In their situation, going by all that occurred I would be pretty peeved about the licensing & ownership stupidities.
I don't reckon this is your normal Abandoned scenario, I reckon it is a little more focused and targeted than that, and so for those overly concerned about the possibility of nasties being included, I would say it is likely to be the opposite.
Especially with Rock, Paper, Shotgun's involvement ... which would appear to be out of character for them.
My own personal view on copyright, is that it is only as good as it is worthy of respect, and in instances like this, there can be no respect for the copyright holder(s), as they are keeping a good game down, and obviously don't care about consumers or those who put the effort into making the game.
So one can blindly follow the law in these things, like a good little robot, or one can make a stand against such thoughtless bad behavior and strike a blow for freedom. Rules and Laws are meant to be broken when they no longer serve as they should. Many of us see Laws and Rules as guides made by others that we don't necessarily agree with, and so at the end of the day, it is about respect and justification.
