And they have waited all this time to launch a lawsuit right before the game is going to receive a full release. What's the point? Haven't they heard about it before? Or maybe they just planning to settle the case for a fraction of money and "allow" Interceptor/3D Realms to leave a name intact?
I don't like this situation at all.

In 2009, British heavy metal band Iron Maiden sued Rubin and Aspen Comics, citing Iron and the Maiden as an infringement of their trademark.

Recent solicitations for the collected edition show that the series has been renamed: The Iron Saint.

John Fogerty once had a copyright suit filed against himself.

TRUE

They came after him claiming his song Old Man In the Road was a ripoff of the song Run Through the Jungle.
The suit would have worked had it not been for one minor detail: John Fogerty wrote Run Through the Jungle

"A six-person jury decided in Fogerty’s favor in November 1988 that he did not steal his own song. The singer-songwriter showed up for each day of the two-week trial and even spent one day playing bits and bobs of “Proud Mary,” “Fortunate Son” and the two songs at issue for the court. He estimated that he’d spent “about $400,000, more than the song earned” in his legal defense. He later countersued Fantasy to get his legal fees back in a suit that went to the U.S. Supreme Court, which ruled in his favor in 1994."

Even with that being true, there are circumstances where he wouldn't own the copyright. If he wrote it as a work for hire, for instance he would likely have lost all rights to use it, or reproduce anything too heavily "inspired" by it.

Time to buy a ticket and fly to US and kick their arses ! people in the entertainment industry is a bit too sue happy. Couldn't they have settled this in a better way.
