Konrad: It won't - the games inside your Piñata are only generated once you go through checkout. Even we don't know what you'll get until the very end.

That said, if you end up getting stuck with a bunch of spare gifts (or a Base/Deluxe edition of a game you own already), you can always contact support to use the 30 Day Money Back Guarantee - or simply convert them to store credit. Just keep in mind this applies to the Piñata's price, not the game's full value. ;)
I'll go on the record and share that I also have received a game I already owned (one I got in the Mutator promo, appropriately) even though there were other games available in the promo (according to what others are posting) that I do not own.

Still can't select it. When I touch the checkbox the checkout page acts as if it would try to pop up additional information underneath (probably) email address to gift it to) but it never ticks the checkbox. Guess the page is not touch Friendly.
Oh you have a touch interface? Yeah than you are out of luck. This site does not handle that well. I also had trouble with that.

EDIT: lol, looking at the pinata tracking thread it seems like the list only contains two games I already own somewhere else. Both of which I received. Just my luck. :D

PalioDeMonte: In my case I think it was because I ordered the Piñata as a gift. I presume you have to add it directly to your account to get something you don't have yet.

IAmSinistar: That could be the case, since I bought a gift Piñata as well. However, looking at the Piñata list, there are three games I don't have and only one I want (and that's only in the Piñata as the Regular Edition). So it's not worth me buying another one, since the likely outcomes are either a game I don't want or the inferior edition of one I do want.

Roll on the next round. :)
That was not the case for me. I did the piñata normally, not as a gift, and still got 3 games I already owned:

It's not a type of promotion I would have suggested but after buying 4 pinatas I warmed up to the concept. It's not that I got something I wanted for cheap but rather that I got some things I was on the fences about or that might make me try something outside my comfort zone.

Here's what I got so far:

Dust: An Elysian Tail
Platform Action RPG aren't my normal cup of tea but I do have some in my library.

Book of Unwritten Tales: The Critter Chronicles
I like adventure game and have the first one (unplayed), I just so not find this one and the other(s) attractive.

1954 Alcatraz
This one I probably would have bought for $3.

Gods Will Be Watching
This one is really outside my comfort zone if I go by the art style and description. The only way I would have bought it normally is as part of a bundle if I really want the others.

You're right. Sorry if we were being misleading with this, we'll update the FAQ with more specifics. Basically, if we want to get into the randomness-algorithm, here's roughly how it works:

The Pinata lineup is separated into timed pools with limited quantities, each pool includes more of some games and fewer of others. Theoretically, it's possible for a game to be "sold out" in one batch.

So if you're missing a game from the lineup it will be prioritised as long as there are copies left in the given batch. Basically, we did this to spread the games out evenly across the entire promo and avoid a situation in which all the best deals are gone right off the bat.

Leroux: Yes, but only once this year, and only about 20%.

The annoying thing about this promo is that it offers you the possibility of getting expensive games that never received a good discount so far, for next to nothing all of a sudden, but you'll likely end up spending a lot of money on games you didn't want to buy in the first place instead. I'd rather have these more expensive games being offered with a mildly attractive discount for a change and pay thrice or four times the price of the Pinata for them than to gamble and waste my money on something I don't want. It's a nice idea on paper, and I don't want to be a spoilsport for those who find this sale event fun and exciting, but personally I preferred spending ~$3 each on discounted games in the Humble Store sale, knowing what I would get.

Let's hope that Republique and Dreamfall Chapters will also appear in the open sales section later on, but I doubt they'd get a 60-70% discount there ...

Id rather buy Republique for 10 € with the certainty that I I get it for that price, than spending those 10€ for a small chance of getting said game.

Yeah, thatd be amazing. Id say 40 or maybe even 50% are more likely, which would be fine. ^^

Thanks Hobbes, pretty much how we had it sussed out. It's okay, I only did one gamble, and as I mentioned elsewhere there's nothing really in this Piñata pool I want overly much, so I'm giving it a miss until the next Piñatas appear.

I'm guessing the frequency of batch renewal is staggered to appear semi-random. Otherwise if it's on a predictable mark such as an hour, then there will be waves of purchases when it hits followed by subsidence. A random renewal period would keep buying more even, though be less appealing to those like me who wish to game the system. :)
I miss Insomnia Sale. that was really fun. pinata is too much riski for me (but maybe I will just gift one to a friend).

Also nobody found a game I wishlisted.
