I get the feeling that this game is not on GOG only because of the bugs that happen on newer systems, making the game unplayable.
Most of them however are solved/mitigated.

Namely these bugs:
1) Fails to install on modern systems.

2) Inevitable Crash at the start of level 7.

3) The pickup bug where a picked up item occasionally stays stuck in the lower right corner of the screen and freezes your inventory.
WORKAROUND: Can be circumvented by quicksaving before every item pickup and quickloading in case the bug appears and picking up the item again until it works correctly and properly goes into your inventory.

4) Crash when shooting weapons (especially fast shooting ones).

1), 2) and 4) can be fixed/mitigated by using this custom fan-made installer. It completely fixes 1) and 2) and greatly reduces the risk of 4) occurring (happens only very rarely with the submachine gun). I completed the game using the custom installer with pretty much no issues except for a very rare-occasional crash due to 4).

This game deserves to be here. It also has several thousand wishlist votes. It is unfortunate that 3) doesn't have a full fledged fix and just a workaround, but is that reason enough to prevent probably the best game from the entire series from being here? It is obviously not because of the license because other Indiana Jones games are here. Finally adding this game to GOG would also fill an obvious hole in the roster of Indy games. Not to mention that being the only place where a game is being sold has its own benefits.

IJatIM will probably never work flawlessly on modern systems. Heck, it has these bugs on anything that isn't Win98. The custom installer is the best thing we've got and probably will ever have. Either you take it like that or leave it forever, which would be a damn shame.
Are these really the only issues that the game has with modern Windows systems (7, 8, 10)? Can GOG secure the unofficial fix creator's permission to bundle it in their own installer? Will Disney approve the bundling of unofficial code in their game? GOG releasing the Emperor's Tomb before the Infernal Machine implies that they couldn't get the latter to run in a way they found satisfactory.

There are other issues as well. Such as menus not opening, resulting in you having to task kill the game. Options not being saved (you have to change the resolution each time you launch the game for example.) Just to name two more.

Op is right in saying that the game will most likely never run flawlessly on newer systems (it never ran flawlessly when it was released.) And as much as i'd love to see the game released here, they need to fix some of the issues first.

I'm not sure the creator of the fix can even be tracked and Disney obviously allowed all other Indy games to be here. Why would they care if some 20 year old game contained an unofficial fix when they are too busy milking and ruining Star Wars.

Menus (inventory) not opening is mostly likely the result of the inventory bug I mentioned. I don't quite remember if the resolution stayed or not (was a few years back when I played) but that is again, a pretty minor thing. You however have to play in 4:3 resolution, otherwise the game doesn't fit on the monitor correctly. I think I played in 1280x1024 which got automatically stretched on my 16:9 monitor.

But I get that some people are harsh customers and will use any opportunity to get back at GOG in case they release something that is not 100% fully functional. GOG is probably staying on the safe side here which is understandable... That most likely means that this game will never be available for sale again (but then again, that is what abandonware sites are for).
I personally found the 64-bits installer here several years ago, and I think it's the page of the original creator of the 64-bits installer. (The one you linked seems to be a version made from someone who build a new version over the one I'm linking.)
The installer I linked allowed me to play it (the french version !) on my Win7 64bits. It was so nice ! :D
There was some issues, sometimes annoying but not too big (simply had to restart the game to fix them). Only one was really an issue, the beginning of a level which made the game crash every time... Fortunately, the creator of the patch uploaded too saves at beginning of each level if you have this kind of issue. But finally after still trying to load my own save, it finally worked !

I really hope it would come here, but unfortunately, like others said, I'm not seeing that soon (if ever), which is a real shame :S I love this game a lot !

Good find, that seems to be the original author, but his installer only allows you to install the game and doesn't fix bugs (for example the crash at the beginning of level 7) it would seem.

The guy who uploaded the installer I linked to most likely took the one you linked (he said it was from a german friend) and made additional improvements/fixes to it. It fixed the game completely for the most part. Crashes only very rarely when shooting and the inventory bug still happens from time to time but as said, it can be easily circumvented by quicksaving and picking up the item again until it works.

There is always a small chance that ResidualVM will expand to cover action adventures and if that happens, presumably games like this would be among the first ones to be included. I don't suggest anyone to get their hopes up though...

Star Wars was ruined by George Lucas a decade or two before Disney ever came into the equation at all...

This is pretty off-topic but yes, the decline started with episode 6 and the marketing teddy bears that defeated the elite imperial army.
The prequels were so-so, but compared to the Disney ones, they are the apex of cinematography.
