Probably true. That said, if GoG did manage to somehow pry Outlaws out of LucasArts' dessicated, claw-like grip, I'd do something drastic to show my affection for them. Like mail them my firstborn*.

Feels weird to me they hinted at it saying outlaws, that's confusing if they're not releasing it.

Elwin: BTw, how do the Desperados compare to the Commandos series? Does it feature the same tough-as-nails hardcore gameplay or has a more relaxed feeling to it?
I remember Desperados as being harder than Commandos, but similar. Bigger levels in some cases as I recall. On the plus side, Desperados had some interesting controlling moves. Such as the ability to leanout from behind cover, fire, then duck back into cover. There was also a kind of a "macro" function, called "Quick Actions", so you could string a bunch of commands together, like move to point X + fire. You could give each character a different QA, and then "trigger" all quick actions to fire simultaneously, for coordinated assaults, etc. Pretty cool.
I never finished it because some of the levels were HUGE and real brain busters, whereas I did finish Commandos. But Desperados was awesome, and had a great old West feel to it!

The fact that they said Outlaws is what makes it obvious that it isn't outlaws. For one, they said they would release Atari games, Outlaws is LucasArts. Desperados is Atari. Another reason is that they it was meant to be a hint. Saying the game title "Outlaws" in the hint is almost obvious that that wouldn't be it. Plus, in Outlaws, your a marshal shooting Outlaws, you never ride with them.

If I remember the promotional conference clearly, all the mystery games are Atari releases so it will be whatever popular western game from the nineties that Atari managed to get it's hands on.
