I haven't played IceWind Dale so I'm not wanting to be too quick to jump on this, but is Gamersgate using GOG created screenshots? The image on their website has a combat log saying GOGer, GOGClerica, and GOGSorcerer, and is the exact shot found on the GOG page.

They probably get screenshots through Google's / Bing's image search.

I believe that gamersgate got the images from atari. Someone wrote some time ago he bought a Ubisoft game bundle and there was also a gog game in the package. I guess that the publishers have the right to use gogs work (installers, screenshots, etc) after some time for other releases.

Sure is. They specifically modified the EXE to make sure it was. The only issue I've ever run into was with outside utilities (like the Oblivion Script Extender) that modify the EXE, though I have heard that this issue was fixed.
