"Making" the same song is infringement, IF both artist try to claim credit for writing it. Otherwise it's just a cover and completely legal. (I have five versions of "Times Are A Changin").

If you bought a bottle of Pepsi at Walmart, does it mean they are the only store that can sell Pepsi? Since your example mentions songs, isn't it possible for you to buy the same music CD at two different stores? A game is a product just the same.

A game's ownership belongs to... someone. Usually it's the publisher, sometimes the dev, maybe none of them if a third party bought the rights. Whoever it is can make deals with stores to sell their product and nothing forbids them to make a deal with more than one store.

From what I can tell, from the little research I've done (huge Metal Fatigue fan myself as well), the issue might lie with the fact that the game was published by Psygnosis in Europe, which was assimilated into Sony, and by TalonSoft in the US, which in turn was assimilated by Take Two. Neither Sony nor Take Two are known for their charitableness with their IPs, and, well, who knows who actually owns it these days? For them, the legal costs of getting to the bottom of that might not be worth getting MF republished on the PC via GOG, in their eyes.

You know what's odd? Last time I looked at the Steam store page, the regular non-sale price of TW3 is $39.99 while here at GOG it is $49.99. One would think that here at GOG it would be cheaper?
