HunterZ: Descent 1 & 2 source code was released a long time ago, which is why there are some good source ports:

BoxOfSnoo: Yup, but you still need the data files for the game assets.
There's always eBay; I've seen
copies of D2 for $7.95 USD.
A_Future_Pilot: The other possibility is for Parallax to release the game files themselves as open source. This is probably a much more likely thing to happen.
Does Parallax have even the legal right to do that? Because even if they had the possibility of doing that, that would be awesome.
negatratoron: Alright, so where should we go to get good old games now? GOG apparently caves like a souffle at the slightest legal trouble.
hummer010: I tried to write several witty responses to this, but in the end, the shear stupidity of this statement rendered me speechless.
Bravo!
This reminds me of the late beta days of GOG, where people were saying things like, "Why should GOG wait for the legal rights to sell old games? They should just put up the installers and wait to get sued so they know who the rightsholders are, LOL."
