anothername: I'm pretty sure as an adult it is against the law to exclude me from buying these games; they are not Manhunter magnitude banned. Its just that they are safer with the "think of all the children!" route.

Pherim: That's the proplem with these kind of "banned" games - it is NOT illegal to buy or own them (if you are 18 or older, of course), but depending on whether they are just "indiziert" (Put on the index) or "beschlagnahmt" (confiscated) it can be illegal to SELL them. Both Commandos (English version!) and Wolfenstein 3D are confiscated, so they cannot be sold within Germany. The other games are just put on the index, that means it is not allowed to advertise and openly sell them. Of course, when these laws were made, digital stores like GOG were not around, so now they rather completely block these titles. I don't know if it were possible to create a system that would allow Germans of legal age to buy them.

Anyway, it is very unlikely that buying these games one way or another could end "badly".
I didn't say buying the games would end badly. I said openly discussing ways to subvert GOG's method of abiding by German law could end badly, as in posts deleted and countermeasures taken to defeat said subversions.

For whom? Purchasing and owning these games is perfectly legal in Germany. Selling them to Germans is not (at least for GERMAN online shops, legal opinion is all over the place when it comes to foreign shops) but preventing Germans from buying them online by means of IP blocks is considered enough, so GOG's off the hook, too.

And at the end of the day, VPN will always work, so what's the point of working against some cookie tinkering to make these games visible?

Pherim: Well, pornography is a different matter - as pornographic material is automatically put on the index in Germany, it is not allowed to publicly advertise it and sell it openly.
Strange, some of the best European porn comes from Germany? In the nineties Maximum Perversum and associated labels, more recent John Thompson's labels. How can it be they have such proliferate and high-quality output if they're illegal?

The index does not mean something is illegal. It means you cannot advertise it, and you cannot have it on display at a store. An adult can come in the store, ask for the product, show proof of age, and get the item he asked for. A minor shouldn't be aware that they sell said object there, though if they do and ask for it, they should be denied access to it.

I think they get around that by having an anteroom, where the age check is done, then access to the rest of the shop is provided. Haven't been to a German sex shop though, so can't really say what is and isn't provided there though.
