just run the game today on win8 it works fine. apart from minimizing every single time it loads.. but yea still works :P

I have had few issues myself on Windows 7 anyway. However when going back to start the game it kept failing to load. A simple game reinstall fixed this issue. I think it was maybe because I installed the DX2 texture pack which I read today is not compatible with digital copies of the game (or something like that).
