Havner: What I would really like to know is whether we'll get DRM free version of this patch from GOG in case it will override some files with protection removed. It seems that this patch is Maddox internal thing, distributed by him, not by Ubisoft.
AFAIR 4.09 beta was working just fine, but in case 4.09 won't any comment from GOG?

First of all we'd have to wait for the release. Than, after hours of having fu.... of testing, we'll try our best to have a working DRM-free version.
