AgentBirdnest: Hello to everyone who showed up while I was finishing Knock-Knock.
Greetings Agent *big hug*
O_o...why?

omega64: Remember the Banner Saga guys being sued over using the word Saga?
By the Candy Crush Saga guys... O_o

AgentBirdnest: The credits rolled :-p
Good enough.

That did remind me Candy Crush contained the word saga though.
I guess that's something. xD

omega64: Capcom puts trademarks behind Resident Evil which makes sense. Less so with the Japanese title Biohazard.
That is different, they can own the phrase "Resident Evil", but not just "Resident" or "Evil", as Activision keeps saying they do. If they claim the whole title as a full brand then that is one thing, but they are claiming ownership of single generic and unoriginal words.

But that was not quite legal, they do not own the term in all regions, especially not English regions. As far as I know they got the TM for a few non-English speaking regions only (if any at all), and TM law is generally a regional thing, so it can't be applied across the board like this.

ElTerprise: Or they found loopholes in the American trademark system? Who knows? As long no contests that? It's the same with Bethesda suing Mojang over the word "Scrolls"....
But would they not only effect the US, not globally, as US trademarks are only valid in the US?

avatar
AgentBirdnest: I thought this kind of thing sounded familiar... EA does the same thing.

Black :-)
Who knows. I don't know enough about it all, but I am still inclined to believe it is not quite legal and is bully tactics.

Well does that elevate the game in any way aside from having a fancier name?
I should clarify that I may very well be mistake in all that I said. My law days are in the past and it has been some years since I really studied the subject, and even then it was English law.

As I said that makes sense, Trademarking the Japanese title Biohazard seems weird though. ;)

According to the devs, yes.

Is it only trademarked in Japan though? With it not being a native word, those can often be trademarked in certain cases, but not usually generic terms in their language.

I mean, Coca Cola don't even own the word Cola as it was deemed too generic, despite the fact they coined the term.

Yeah, I guess they were too late on trademarking that one.
Not sure if it's only trademarked in Japan, I guess that would make more sense.

Sure they can be trusted xD

They were, they left it too long, and by then it was so widely used they could not get the trademark despite coining the word. But they still own Coca Cola as a whole.

Because I started it.

What does "have" mean anyway, really? :-)

So, what does your new title mean? :-)

That you're not forced to finish the game by someone pointing a bazooka at you :P

It means that my chosen title was one character too long xD
You guys looking forward to next week's release? :-)
