Legally free at the time. At least in the US. The Confederate States did allow slaves to join their army (with their master's consent) at the very end of the war, and they would be freed in return, but not many signed up, and the war ended a few weeks later anyway.
(It is generally a bad idea to give slaves guns anyway :-p)
